3. Project Scope

Each project is limited to the work specifically described in the applicable proposal, estimate, invoice, statement of work, contract, or written project agreement.

Requests that extend beyond the agreed project scope may require additional development time and additional fees.

Out-of-scope work may include additional pages, features, integrations, redesigns, functionality, revisions, data migration, troubleshooting, content entry, server work, or changes to previously approved work.

4. Client Responsibilities

Clients are responsible for providing the information, materials, credentials, approvals, access, content, and other resources reasonably required to complete a project.

Clients are responsible for responding within a reasonable period when feedback, approval, or additional information is required.

5. Estimates, Quotes and Proposals

Quotes and estimates are based on the information and project requirements available at the time they are prepared.

If project requirements materially change, additional work may require an updated estimate or additional charges.

Unless specifically stated otherwise, an estimate is not a guarantee that every possible circumstance, revision, integration issue, third-party limitation, or unforeseen technical problem is included within the quoted amount.

6. Pricing and Payment

Payment requirements will be communicated through the applicable invoice, proposal, estimate, agreement, or other project documentation.

7. Deposits and Advance Payments

Unless otherwise stated in writing, deposits may become non-refundable after work begins or development time has been reserved for the project.

8. Timelines and Project Delays

Project timelines and estimated completion dates are provided in good faith based on the information available at the time of the estimate.

Unless specifically guaranteed in writing, project completion dates are estimates rather than guaranteed deadlines.

9. Revisions and Change Requests

Requests for entirely new functionality, major redesigns, additional pages, additional integrations, or substantial changes to previously approved work may be treated as additional development rather than revisions.

10. Client Review and Approval

Clients are responsible for reviewing project work, functionality, designs, content, calculations, integrations, forms, checkout flows, pricing, and other deliverables before approval or launch.

Once a project component has been approved, substantial changes to that component may require additional development fees.

11. Client-Supplied Content and Materials

Clients are responsible for ensuring that materials supplied to Scott Ellis - (DBA legitdevelopers.com) may legally be used for the project.

12. Third-Party Services and Platforms

Modern websites frequently depend on services operated by third parties, including hosting companies, domain registrars, cloud providers, payment processors, Shopify, WordPress, applications, APIs, analytics platforms, advertising platforms, CRM systems, and communication providers.

Scott Ellis - (DBA legitdevelopers.com) does not control these third-party services and cannot guarantee their continued availability, functionality, policies, pricing, security, or compatibility.

Work required because a third party changes its API, platform, software, policies, infrastructure, or technical requirements may be considered additional development.

13. Software, Plugins and Licensing

Some projects require third-party software, themes, plugins, applications, APIs, stock media, fonts, subscriptions, or other licensed products.

Unless specifically included in the project price, the client is responsible for purchasing and maintaining required third-party licenses.

14. Hosting, Servers and Domain Services

Scott Ellis - (DBA legitdevelopers.com) may provide or assist with hosting, servers, domains, DNS configuration, deployment, SSL certificates, databases, and related infrastructure.

Unless otherwise agreed in writing, clients remain responsible for renewing their domains, hosting accounts, licenses, subscriptions, and other services registered in their name.

Scott Ellis - (DBA legitdevelopers.com) does not guarantee that a website, domain, server, network, API, database, or third-party infrastructure service will operate without interruption.

15. Website Maintenance and Ongoing Support

Completion of a development project does not automatically include unlimited future maintenance or technical support.

Unless covered by an active maintenance or support agreement, future updates, troubleshooting, software updates, compatibility work, content changes, server work, or feature requests may be billed separately.

16. Website and Application Security

Scott Ellis - (DBA legitdevelopers.com) uses reasonable development and security practices appropriate to the services being performed.

However, no website, server, application, API, database, or internet-connected system can be guaranteed to be completely secure or permanently free from vulnerabilities.

Clients are responsible for maintaining appropriate account security, passwords, backups, access permissions, and software updates after project delivery unless those responsibilities are included in an ongoing agreement.

17. Browser, Device and Software Compatibility

Scott Ellis - (DBA legitdevelopers.com) makes reasonable efforts to develop websites and applications that function properly on modern web browsers and commonly used devices.

Differences between operating systems, browsers, devices, screen sizes, software versions, extensions, privacy settings, and third-party technologies may affect appearance or functionality.

18. Website Performance and Business Results

Development services may support marketing, eCommerce, advertising, analytics, search optimization, conversion optimization, automation, or other business activities.

Scott Ellis - (DBA legitdevelopers.com) does not guarantee a particular level of traffic, search engine ranking, conversion rate, revenue, sales, leads, advertising performance, customer acquisition, or other business result.

19. Intellectual Property and Ownership

The client retains ownership of intellectual property originally supplied by the client.

Unless otherwise stated in writing, rights to final custom project deliverables created specifically for the client are transferred after all amounts owed for the applicable project have been paid in full.

Scott Ellis - (DBA legitdevelopers.com) retains ownership of pre-existing code, utilities, frameworks, development tools, reusable components, processes, techniques, methods, templates, libraries, and general programming knowledge used while providing services.

20. Portfolio and Project Attribution

Unless otherwise agreed in writing or subject to a confidentiality obligation, Scott Ellis - (DBA legitdevelopers.com) may display publicly available portions of completed work as examples of our development services.

Confidential business information, private credentials, customer data, proprietary internal information, and other non-public materials will not intentionally be published as portfolio content.

21. Project Suspension and Termination

Either party may terminate a project according to any applicable written agreement.

If a project ends after work has begun, the client remains responsible for payment for work completed, approved expenses, third-party costs, and other amounts owed through the termination date.

22. Limitation of Liability

To the fullest extent permitted by applicable law, Legit Developers will not be responsible for indirect, incidental, special, consequential, exemplary, or punitive damages arising from the use of this website or our services.

This may include lost revenue, lost profits, lost sales, lost customers, lost data, business interruption, advertising expenses, third-party service failures, platform outages, payment processor failures, security incidents, or changes to third-party systems.

To the fullest extent permitted by applicable law, the total liability of Scott Ellis - (DBA legitdevelopers.com) arising from a specific project or service will not exceed the amount actually paid to Legit Developers for the specific service giving rise to the claim.

23. Website Use

Information available through legitdevelopers.com is provided for general informational, marketing, communication, and business purposes.

You agree not to misuse this website, interfere with its operation, attempt unauthorized access, introduce malicious code, overload infrastructure, or otherwise attempt to damage or compromise the website or its services.
